1.Referring to Article 31 of the Vienna Convention of the Law of Treaties, the Commission stated that the wording 'the rights set forth in this Convention' presupposes total, not partial recognition. 2. Any State availing itself under Article 15 of the right to derogate, in time of war or another emergence threatening the life of the nation, from one or more provisions of the Convention, must keep the Secretary General fully informed of the measures taken in that context and the reasons therefor. 9. The Court held that the applicants must be able to communicate freely with the Commission without being subjected to any form of presssure from the authorities to withdraw or modify their complaints.
