Citizens’ obligations in the environmental protection sphere: legal fixation problems

Annotation

The article is devoted to the citizens’ obligations in the environmental protection sphere legal fixation problems. Analyzing the existing in the theory of Law approaches the author pays special attention to the link between the subjects’ rights and obligations, and also comes to the conclusion that one of the indispensable conditions of legal obligations existence is establishing the measures of governmental compulsion in law in the case of their non-observance.

The author offers a classification of citizens’ environmental protection obligations, established in article 12 of the Environmental Protection Law of the Republic of Belarus. Such approach allows revealing a number of obligations not juridical according to the offered criteria, as well as obligations lying in the plane of the nature resources usage legislation and defined more elaborately in this approach.

At the end of the article the conclusion about the necessity of more distinct assignment of legal obligations connected with environmental protection is well founded and proposals concerning improvement of corresponding principals of the Environmental Protection Law are formulated.
